Advocate general Philippe Léger concludes that these bags conform both to the existing directive’s general definition of packaging as well as to its definition of ’transport packaging’€™.
Exclusion of plastic bags from the definition of packaging would compromise EU objectives by placing them outside national packaging waste collection and recovery systems, according to Mr Léger.
