Gibraltar excluded from EU green rules

There are some 85 EU laws whose aims include the enhancement of environmental protection. With support from Spain, the European Commission prosecuted the British government for failing to ensure compliance with 14 such directives in its colony of Gibraltar.
The Commission acknowledged that, under Britain’s act of accession to the EU, Gibraltar was excluded from the EU’s customs territory, thus legally putting it outside the Union’s single market. But it argued that it would be ’paradoxical’ and ’illogical’ for this automatically to free Gibraltar from a duty to comply with many important environmental rules. However, the judges in Luxembourg judges reiterated that Gibraltar was excluded from the EU’s customs union and that – paradoxically or not – it was not subject to internal market directives.
