France – The Douai Appeal Court has awarded damages to 187 former Metaleurop Nord SAS employees ‘for loss of a chance to keep a job’, the French lead, zinc and plastics recycling specialist Recylex SA has confirmed.
Rejecting the rulings made by the Lens Labour Court (Industry section and Management section) in 2013 which considered Recylex SA as co-employer of the employees of Metaleurop Nord SAS, the Douai Appeal Court concluded that Recylex SA committed faults and caused prejudice to the 187 former Metaleurop Nord SAS employees.
It has ordered Recylex SA to pay each of them an amount between Euro 15 000 and Euro 53 000 in damages as well as Euro 400 in costs, representing a total sum of just under Euro 7.76 million. Provision for these claims, which were originally brought in 2010, has been made in Recylex SA’s finances.
‘Recylex SA has sufficient financial resources to bear them,’ the company states. ‘Recylex is studying with its lawyers the possibility to appeal to the Cour de Cassation.’
